Terms of Service

1. Acknowledgment

This EULA is a legal agreement between you ("End User" or "you") and Jobivo ("Jobivo," "we," "us," or "our") for the Jobivo application and related web service (the "Application"). Where you download Jobivo from an app store such as Google Play or the Apple App Store, this Agreement is between you and Jobivo, not the app-store provider. Jobivo is solely responsible for the Application and its content, and your use must also comply with the applicable app store's terms.

2. License Grant and Scope

Subject to this Agreement, Jobivo grants you a limited, non-exclusive, non-transferable, revocable license to use the Application to run your own field-service business operations, on devices you own or control and in accordance with your subscription plan.

You may:

• Install and use the Application on devices you own or control
• Invite team members to your workspace under your account
• Use the features and functionality provided in your plan

You may not:

• Resell, redistribute, sublicense, or rent the Application to third parties
• Copy, decompile, reverse-engineer, disassemble, modify, or create derivative works of the Application
• Use the Application to build or train a competing product or service
• Remove any proprietary notices or labels

3. Accounts and Subscriptions

Jobivo offers a free tier and optional paid subscriptions (for example, per-engineer monthly or annual plans). Pricing displayed in the Application and on the relevant app store or billing page prevails and may vary by region.

• Auto-renewal: paid subscriptions automatically renew unless cancelled before the end of the current period; your payment method is charged at renewal
• Managing subscriptions: you can manage or cancel a subscription in your account settings or, for app-store purchases, in your app-store account
• Free trials: if offered, any unused portion of a free trial is forfeited when a paid subscription begins

4. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Application you acknowledge that data you enter — including job, customer, and photo records — is stored in secure cloud storage and cached locally on your device for offline access, and is synchronised between them.

5. Your Content and Conduct

You retain ownership of the jobs, customers, photos, notes, and other content you create using the Application ("Your Content"). You grant Jobivo a limited license to host, process, and display Your Content solely to provide the Application's services to you and your workspace.

You are responsible for Your Content and for having any necessary rights, consents, or lawful basis for the information and photographs you upload, including those of customers, sites, and individuals.

You agree to:

• Use the Application in compliance with all applicable laws
• Provide accurate information
• Not use the Application for any unlawful or harmful purpose
• Not attempt to gain unauthorized access to any portion of the Application or another workspace

6. Intellectual Property

The Application, including its design, features, documentation, and all associated intellectual property rights, is owned by Jobivo and protected by copyright, trademark, and other laws. "Jobivo," "Jobivo," and associated logos are trademarks of Jobivo.

7. Maintenance and Support

Jobivo is solely responsible for providing maintenance and support for the Application. App-store providers have no obligation to furnish support services. For support, contact support@jobivo.co.uk.

8. Warranty Disclaimer

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PYLONCO DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Jobivo does not warrant that:

• The Application will meet your requirements
• The Application will be uninterrupted, error-free, or secure
• Results obtained from the Application will be accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PYLONCO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OR INABILITY TO USE THE APPLICATION.

Jobivo's total liability shall not exceed the amount you paid for the Application in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold Jobivo harmless from any claims, losses, or damages arising from Your Content, your use of the Application, or your breach of this Agreement.

11. Third-Party Services

The Application relies on third-party services (including Supabase and Firebase) and may run on devices and networks governed by their own terms. You must comply with any applicable third-party terms when using the Application — for example, your wireless data-service agreement.

12. Legal and Export Compliance

You represent and warrant that:

• You are not located in a country subject to a government embargo or designated as a “terrorist supporting” country
• You are not listed on any government list of prohibited or restricted parties
• You will comply with all applicable laws in your use of the Application

13. Termination

This Agreement is effective until terminated. Your rights terminate automatically if you fail to comply with any of its terms. Jobivo may suspend or terminate your access for any reason, including breach of this Agreement. Upon termination, you must cease all use of the Application.

14. Governing Law

This Agreement is governed by the laws of England and Wales, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the courts of England and Wales.

15. Changes to This Agreement

We may modify this Agreement at any time. We will notify you of material changes through the Application. Your continued use after notification constitutes acceptance of the changes.

16. Entire Agreement and Severability

This Agreement constitutes the entire agreement between you and Jobivo regarding the Application and supersedes all prior agreements. If any provision is held invalid or unenforceable, the remaining provisions continue in full force and effect.
